Terms and Conditions

Please read these terms and conditions carefully before using our services.

Acceptance of Terms

By accessing and using the services of Family Affair Credit Repair LLC ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

Service Description

Family Affair Credit Repair LLC provides credit repair and counseling services, including:

  • Credit report analysis and review
  • Dispute of inaccurate, outdated, or unverifiable information
  • Credit counseling and education
  • Debt management guidance
  • Financial planning assistance
  • Credit monitoring services

Credit Repair Organizations Act (CROA) Disclosures

Service Limitations and No Guarantees

While we work diligently to improve your credit profile, we cannot guarantee specific results or outcomes. Credit repair results vary based on individual circumstances, including:

  • The accuracy of information in your credit reports
  • The response of credit bureaus and creditors
  • Your compliance with our recommendations
  • Your ongoing financial behavior
  • Changes in credit reporting policies and procedures

Client Responsibilities

To ensure the best possible results, you agree to:

  • Provide accurate and complete information about your credit situation
  • Supply necessary documentation promptly
  • Follow our recommendations and guidance
  • Refrain from applying for new credit without consulting us first
  • Notify us immediately of any changes in your financial situation
  • Pay all fees according to the agreed schedule
  • Not attempt to repair your credit through other means while using our services

Fees and Payment Terms

Service Plans:

  • Basic Credit Repair Plan: $99/month plus $99 setup fee
  • Premium Credit Repair Plan: $149/month plus $149 setup fee

Payment Terms:

  • Setup fees are due upon signing the service agreement
  • Monthly fees are due on the same date each month
  • We accept payment by credit card, debit card, or bank transfer
  • Late payments may result in service suspension
  • No refunds after the 3-day cancellation period, except as required by law

Cancellation and Termination

Your Right to Cancel:

  • You may cancel within 3 business days of signing for a full refund
  • After the 3-day period, you may cancel with 30 days' written notice
  • No refund of fees already paid after the cancellation period

Our Right to Terminate:

We may terminate services if you:

  • Fail to pay fees when due
  • Provide false or misleading information
  • Fail to cooperate with our processes
  • Engage in fraudulent or illegal activities

Confidentiality and Privacy

We maintain strict confidentiality of your personal and financial information. We will not disclose your information except:

  • As necessary to provide our services (e.g., communicating with credit bureaus)
  • As required by law or legal process
  • With your express written consent
  • To protect our rights or the rights of others

Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited to the fees you have paid for our services
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for actions of credit bureaus, creditors, or other third parties
  • We are not liable for any temporary decrease in credit scores during the repair process

Dispute Resolution

Mediation: Any disputes will first be addressed through good faith mediation.

Arbitration: If mediation fails, disputes will be resolved through binding arbitration in Jefferson County, Alabama, under the rules of the American Arbitration Association.

Class Action Waiver: You agree not to participate in class action lawsuits against us.

Governing Law

These terms are governed by the laws of the State of Alabama and applicable federal laws, including the Credit Repair Organizations Act (CROA) and Fair Credit Reporting Act (FCRA).

Compliance with Laws

Our services comply with:

  • Credit Repair Organizations Act (CROA)
  • Fair Credit Reporting Act (FCRA)
  • Fair Debt Collection Practices Act (FDCPA)
  • Alabama Credit Services Organization Act
  • Telemarketing and Consumer Fraud and Abuse Prevention Act

Intellectual Property

All content, materials, and methods used in our services are proprietary to Family Affair Credit Repair LLC. You may not reproduce, distribute, or use our materials without written permission.

Communications

By using our services, you consent to receive communications from us via:

  • Email
  • Phone calls
  • Text messages (if you provide consent)
  • Postal mail
  • Our client portal

Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures of credit reporting systems.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Modifications

We may modify these terms with 30 days' written notice. Continued use of our services constitutes acceptance of modified terms. Material changes will require your express consent.
